Resolving disputes with the CRA part 1

It is a few weeks after the tax season and many of us have already received our income tax assessments from the CRA.  It is important to note that the CRA is not right all the time.  There are instances where the CRA has misinterpreted the facts or applied the Income Tax Act incorrectly.  It is the responsibility of the taxpayer to make sure that his/her income tax assessment or reassessment is correct and accurate. 

If you find that your assessment or reassessment is inaccurate, your first step would be to call the CRA.  Check with them first if you can resolve your issue with them over the phone.  If this does not work, you may opt to file a Notice of Objection. 

You can choose to file your objection by using one of the following options available:

1.  Using My Account or My Business Account (through the CRA website)

2.  Writing to the Chief of Appeals at your tax centre –

For individuals with postal code ending from R to Y, you can send your objection to:
Chief of Appeals

Burnaby-Fraser Tax Service Office
9737 King George Highway
PO Box 9070 STN Main
Surrey BC V3T 5W6

For individuals with postal code ending from A to P, you can send your objection to:
Chief of Appeals
Eastern Intake Centre
Sudbury Tax Service Office
1050 Notre-Dame Avenue
Sudbury ON P3A 5C1

There are time limits for filing a notice of objection.  For individuals, the time limit is the later of:

  1. one year after the filing deadline of the tax return or

  2. 90 days after the mailing date of the Notice of Assessment


In most cases, the notice of objection must be filed within 90 days after the mailing date of the notice of assessment.  If you do not file within the mentioned time limit, you will lose your right to further appeal on your assessment or reassessment.

When filing your Notice of Objection, remember to include all your reasons for your objection as well as all relevant facts and documents.
